Many unmarried couples assume that if they have cohabited for a certain period of time then they have legal rights similar to married couples. This is usually referred to as being a ‘common law wife or husband’, however, this is not correct.
In fact the Courts do not take into account the length of time you have lived together or even whether you have raised children together. If the property is registered in the sole name of one person then the other has to prove they are entitled to an interest in it.
